INTRODUCTION

Assessment Generator LLC, a Colorado limited liability company, Assessment Generator LLC DBA Agolix (“Agolix”, “we”, “us”, or “our”) operates an assessment generator platform that allows users to create assessment tools for lead generation. 

This Privacy Policy describes how we collect, use and share your Personal Data when you (a) visit our website at https://agolix.com/, (b) use our assessment generator tool as a creator or respondent, or (c) otherwise interact with our online products or services such as e-mail communications (collectively, our “Services”).

“Personal Data” or “Personal Information” means any information relating to you that can identify you. It does not include data where the identity has been removed, such as anonymous data or non-personally identifiable information, such as aggregate statistics.

You” means the individual accessing or using the Services or the legal entity on behalf of which such individual is accessing or using the Services, as applicable. 

It is important that you read this Privacy Policy before using our Services. By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy.  If you do not agree with this Privacy Policy, you may not use our Services.

WE COLLECT DATA FROM THREE GROUPS

The personal information we collect from you will depend on your relationship with Agolix. Depending on how you use our Services, you may be a Creator, Respondent and/or Visitor. 

Creators

Creators” are clients of Agolix. Creators are those who create an account and use our Services to directly create assessments or collaborate on creating online assessments for Respondents to take. 

Respondents

Respondents are those who take an assessment created by our Creators.

Visitors

Visitors are those who visit pages of our website and are not necessarily Creators or Respondents.

IDENTITY OF THE DATA CONTROLLER FOR THE DATA COLLECTED

This Privacy Policy applies when we act as a Data Controller of your Personal Data.

Data Controller

We are the Data Controller when we control how the data is collected, stored and processed. 

Generally, we control how the data is collected, stored and processed with respect to our Visitors.

Data Processor

Our assessment generator tool is intended for use by our clients – the Creators. As a result, for part of the personal information we collect about our Creators and their Respondents, we act as a Data Processor on behalf of our Creators.

Our Creators are the Data Controllers,  and also they are Data Processors as well, for the data that they collect about their Respondents. In other words, our Creators, and not Agolix, determine how and why data submitted by Respondents is used. 

Therefore, we are not responsible for our Creators’ privacy or security practices of our Creators, which may differ from those outlined in this Privacy Policy. We require our Creators to comply with all applicable laws and regulations and to provide Respondents with notice of data collection as outlined in this Privacy.

When visiting our website or contacting us, you provide us with data as a Visitor.

How we process your data as a Visitor is detailed in the Data We Collect From Visitors section.

WHEN YOU CREATE AN ASSESSMENT AND COLLECT RESPONSES

When using our assessment generator tool to create assessments and collect responses, you are the Data Controller. Agolix handles your assessment data on your behalf and under your instructions (including the ones agreed to in this Privacy Policy and the Data Processing Addendum). 

Below are details about the data we process on behalf of Creators.

A. What Data We Collect and How

When you create assessments as a Creator, you may type questions or upload images that will be used in questions or answer choices. Also, when you send your assessments to your target audience, the Respondents manually enter information while answering your questions. 

This data that you, as a Creator, or your Respondents manually enter into our system will be securely saved on our servers.

Note: Uploaded files may contain metadata. For example, if a Creator takes a photo with their smartphone and uploads it in an assessment, the photo may contain metadata such as the geographical location (GPS position) where the photo was taken. 

B. Why We Collect This Data

We collect this information to create your assessments, share them with your audience, and collect responses.  

C. How We Use This Data

We DO NOT use this data in any way. You, as the Creator (or your sub-processors), will use this data.

DATA WE COLLECT FROM RESPONDENTS

When visiting our website or contacting us, you provide us with data as a Visitor.

How we process your data as a Visitor is detailed in the Data We Collect From Visitors section.

WHEN YOU FILL IN AN ASSESSMENT PROVIDED BY OUR CREATORS

When filling in an assessment sent to you by our Creators, you are a Respondent, and we collect your response data. 

Creators create and administer assessments. Our Creators control how assessments are sent and what is done with the information received. The response data provided by Respondents to our Creators are owned and managed by the Creator. 

Agolix hosts the assessments on our website and collects the information on behalf of Creators. We only collect your responses if you submit the assessment. The use of information collected through our assessments will be limited to the purpose of providing the service for which our Creators have engaged Agolix.

To understand how Creators will use the response data, Respondents will need to contact the assessment Creator directly, which is usually the person who asks you to respond to their assessment. 

Below are details about the data we process from Respondents on behalf of Creators.

A. What Data We Collect and How

The data we collect depends on the questions that Respondents answer. We collect all Respondents’ responses, including but not limited to age, gender, revenue, education level, and sexual orientation.

B. Why We Collect This Data

We collect your responses only if “submitted” to be able to show statistics and transfer your opinions or feedback to the Creator who has asked you to provide such information. 

C. How We Use This Data

We DO NOT Respondents’ response data. It is the Creator who sends the assessment who will use such data.

D. Your Choices About Your Data

Respondents have the right to ask Creators to access, correct, or delete their response data. To do so, Respondents must contact the assessment Creator directly.

When visiting our website or contacting us, you provide us with data. 

Below are details about the data we collect from Visitors.

A. What Data We Collect and How

Personal Data

While you are using our Services, we may ask you to provide us with certain information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, the following: 

    • Email address 
    • First name and last name 
    • Phone number 
    • Address, State, Province, ZIP/Postal code, City 

What Personal Data we collect depends on how you contact us. We may collect data about you if you voluntarily provide us with such information in connection with the following:

    • Complete a questionnaire 
    • Fill out a form on our websites
    • Register for an event organized by or hosted by us
    • Subscribe to our newsletter
    • Create an account
    • Participate in a survey, contest, or competition
    • Give us feedback
    • Send us an inquiry, a letter, an email, or a social media message

Usage Data

Usage data is automatically collected when using the Services. 

Usage data may include information such as your device’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. 

When you access the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. 

We may also collect information that your browser sends whenever you visit our Services or when you access the Services by or through a mobile device. 

Social Networking Data

Information from social networking sites and apps, including Facebook, Instagram, Linkedin, Twitter, or other social networks or apps not named specifically here, which may include your name, your social network username, location, email address, and any other public information.

Aggregated Data

We also collect, use, and share Aggregated Data, such as statistical or demographic data, for any purpose. Aggregated Data could be derived from your Personal Data but is not considered Personal Data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your user data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data, which will be used in accordance with this Privacy Policy.

Tracking Technologies and Cookies

We use cookies and similar tracking technologies to track the activity on our Services and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our service.

    • To provide you with news, special offers, and general information about other goods, services, and events that we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information. 
    • To manage your requests: To attend and manage your requests to us.

We may SHARE your personal information in the following situations: 

  • With service providers and advisors: We may share your personal information with service providers to monitor and analyze the use of our Services. Service provider refers to any third-party company or individual employed by Agolix to facilitate the Services, to provide the services on behalf of Agolix, to perform services related to the Services, or to assist Agolix in analyzing how the Services are used.
  • For business transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of business assets, financing, or acquisition of all or a portion of our business to another company. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.
  • With affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners, or other companies that we control or that are under common control with us. 
  • With business partners: We may share your information with our business partners to offer you certain products, services, or promotions. 
  • Legal Compliance: We may share when we believe it is necessary to comply with applicable laws and regulations, respond to a subpoena, search warrant, or other lawful requests, protect you or other users, operate and maintain the security of our Services and related business operations, and protect our rights or property.
  • Aggregate or De-Identified Information: We may share information in aggregate/or anonymous form that cannot reasonably be used to identify an individual. For example, we may disclose aggregated user statistics (i.e., the total number or percentage of users from a particular geographic region) in order to describe our Service to current and prospective partners and other third parties and for other lawful purposes.
  • With other users: When you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If you interact with other users or register through a third-party social media service, your contacts on the third-party social media service may see your name, profile, pictures, and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you and view your profile. 
  • Other purposes: We may disclose your Personal Data as necessary to comply with any legal obligation or to protect your interests or the vital interests of others or our company.

DETAILS OF DATA WE PROCESS WITH SERVICE PROVIDERS OR SUBPROCESSORS

In some cases, we use third-party technologies and services to deliver the best services to our Creators, Respondents, and Visitors. At the time of this writing, we may receive or process Personal Data about you from the third-party services as set out below (updated from time to time and available from us upon request).

Analytics

We may use third-party service providers to monitor and analyze the use of our Services, such as those of Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. 

You can opt out of having made your activity on the Services available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

Email Marketing

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any or all of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us. 

We may use email marketing service providers to manage and send emails to you.

Payments

We may provide paid products and/or services within the Services. In that case, we may use third-party services for payment processing (e.g., payment processors). 

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. We may use Stripe as a payment processor. Stripe’s privacy policy can be viewed at https://stripe.com/us/privacy.

HOW LONG WE KEEP YOUR DATA

We will only retain the Personal Data you provide for as long as reasonably as needed to fulfill the purposes for which we collected it, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Our actual retention periods can vary widely based on the type of data, the nature of the relationship, and our legal and other obligations.

Notwithstanding the foregoing, Creator’s account data and all assessments housed in your account will be retained for a period of one year (12 months) from the date you cancel your account. Free accounts that are not accessed within a period of one year (12 months) are subject to deletion.

SECURITY OF YOUR PERSONAL DATA

The security of your Personal Data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. We urge you to take appropriate steps to keep your Personal Data safe, such as choosing not to send Personal Data through insecure email and closing your browser when finished using our Services or those of any other website on a shared device or unsecured network.

TRANSFER OF YOUR PERSONAL DATA

We maintain data in the United States of America and in accordance with the laws of the United States, which may not provide the same level of protection as the laws in your jurisdiction.  By using the Services and providing us with data, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy.

YOUR CHOICES ABOUT YOUR DATA

You Don’t Have To Provide Us With Your Data

You can choose not to provide us with any Personal Data. Where we are required to collect Personal Data by law, or if it’s necessary for us to provide certain aspects of our Services, if you do not provide us with that data when requested, that may prevent us from providing you with access to certain parts of our Services. In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

You May Request Access, Correction,  Or Deletion Of Your Data

You may request access to, correction of, or deletion of your Personal Data by contacting us as described at the bottom of this Privacy Policy. We may decline your request if: (i) we are unable to verify you are the person to whom the data relates, (ii) it could adversely affect the rights of another person, or (iii) it is unreasonable, excessive, or prohibited.

You May Turn Off Cookies

We may send cookies to your computer in order to uniquely identify your browser, help us improve our Services, and otherwise enhance your experience. A “cookie” is a small file of letters and numbers stored on your browser or your device’s hard drive.

You May Opt Out Of Marketing

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at any time. 

Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of a product or service purchase.

You May Unsubscribe

If you want to unsubscribe from receiving emails from us, you may do so at any time. Each email from us includes instructions for unsubscribing from these email communications.

Compliance With GDPR

If you are covered by the General Data Protection Regulation (“GDPR”), you have the following rights in respect of your personal information that we or the Creator hold:

  • Request Access – You have the right to receive a copy of the Personal Data we hold about you. 
  • Request Correction – You have the right to request the correction of your Personal Data if it is inaccurate or incomplete. We may need to verify the accuracy of the new data you provide to us.
  • Request Deletion This is also known as the “right to be forgotten” and, in simple terms, enables you to request the deletion or removal of your information. We may not always be able to comply with your request for deletion for specific legal reasons, which will be notified to you, if applicable, at the time of your request.
  • Object to Processing – You have the right to object to certain types of processing, including processing based on our legitimate interests and processing for direct marketing. In some cases, we may demonstrate that we have compelling legitimate grounds to process your data which override your rights and freedoms.
  • Request Restriction of Processing – You may request that we stop processing your Personal Data temporarily if:
    • You do not think your data is accurate;
    • The processing is unlawful, but you do not want to erase your data;
    • We no longer need the Personal Data for our processing, but you need the data to establish, exercise, or defend legal claims; or
    • You have objected to the processing because you believe your interests should override our legitimate interests.

CHANGE OF PURPOSE

We will only use your Personal Data for the purposes we collected it unless we reasonably consider that we need to use it for another reason, and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your Personal Data for an unrelated purpose, we will notify you (if we have collected your Personal Data from you directly), and we will explain the legal basis that allows us to do so.

Our Services are not designed for use by children under age 18, and we do not knowingly solicit Personal Data from anyone under age 18.  If you are under age 18, do not access or use our Services or related products or services.  If you become aware that we have collected data from anyone under 18, please contact us so we may delete that data.

The Services may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. For example, if you post something on Facebook (even though we communicate with you on Facebook), that information is governed by the privacy policy on Facebook’s website. When you leave our Services, we encourage you to read the privacy policy of every website you visit.

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will let you know via email and/or a prominent notice on our Services prior to the change becoming effective and update the “Last updated” date at the top of this Privacy Policy. 

If we intend to use or disclose personal information for purposes materially different than those described in this Privacy Policy, we will make reasonable efforts to notify affected individuals in advance, if necessary.
